Human resource departments are responsible for effectively, legally, fairly, and consistently attempting to maximize an organization’s return on its human capital investment while minimizing financial risk.
As director of human resources at Company X, a company with over 75 employees, you are charged with oversight of hiring and employment practices at the company, including compliance with federal regulations against discrimination in hiring and employment. You work with department managers to assist them in dealing with hiring and employment issues, and to ensure they are in compliance with pertinent federal law regarding the treatment of employees.
Three situations have come to the attention of the company’s senior vice-president of operations, who has asked you to analyze each situation, and submit a report regarding whether certain federal acts may apply, or may have been violated, in each situation. The situations are as follows:
Situation A. Employee A has been with Company X for two years. Employee A's spouse gave birth prematurely to twins. He requested leave to be with his spouse, which was granted. ...Minors' Capacity To Contract One of the elements constituting a valid contract is that the parties entering the contract are those who have the competency to contract. This is based on section 10 (1) of the Contract Act 1950 which states: “All agreements are contracted if they are made by the free consent of parties competent to contact, for a lawful consideration and with a lawful object, and are not hereby expressly declared to be void.” Competency refers to the capacity of being an adult, having a sound mind and not forbidden by law to enter any contract (e.g, bankruptcy). This principle is based on section 11 of the Contract Act 1950 which provides that “every person is competent to contract who is of the age of majority according to the law to which he is subject, and who is of sound mind, and is not disqualified from contracting by any law to which he is subject”. In Malaysia, the age of majority is recognized as above eighteen years of age as stated in the Age of Majority Act 1971: “The minority of all males and females at the age of eighteen years and every such male and female attaining that age shall be of the age of majority.” In effect of section 10 and 11 of contract Act 1950, the courts held in the cases of Mohori Bibee V Dharmodas Ghose (1903), Tan Hee Juan V Teh Boon Kiat (1934) and Government of Malaysia V Gurcharan Singh (1971) that all such agreements are void. These situations need to be handled in a delicate matter to make sure that the company is following the guidelines that are setup and established by the federal government to make sure that companies and employees are treated fairly. I would like to discuss three situations that recently have challenged my leadership as a Human Resource Director and show the diversity of the laws and why they were created and how they work. Situation A – FMLA The first situation I am about to describe is an unfortunate set of circumstances, but the law is very clear and the company position is easily seen. Therefore, it was not hard for me to make this decision. The employee was presented with a difficult family situation his twin children were born premature. He made the decision to take leave from work to attend to his spouse and the needs of his family. This is ok and totally understood by the company. Business Law the event of a massive scale shutdown. In evaluating the problem with the JetBlue disaster, we find that the organizations business model was highly based on customer service. It was founded on the basis of offering luxurious flying experience and quality customer services at low prices. The airline operated by offering this low cost service by cutting “unnecessary” expenses, and through the use of (available but inadequate) “simple-is-better” (Laudon, 2010, p. 72) information technology systems. The airline automated all its services, out-sourced other information systems used, employed a very lean non-union workforce in an effort to push spending costs toward supporting their “customer-experience-first” business model. The airline only operated airbus A 320, and when not exclusively using Microsoft software for its information systems, it also used Navitaire, who hosted JetBlue’s reservation system among other airline systems. This approach gave JetBlue a competitive advantage over other airlines such that the airline expanded more rapidly than was envisioned. It was not well rounded enough or large enough to cover its customer’s needs in the time of a major crisis and shutdown. JetBlue was so successful for so long because it was a small organization. Reasons that can make a contract voidable include failure by one or both parties to disclose a material fact.
