Escola V. Coca Cola Co.

...Escola v. Coca Cola Bottling Co. of Fresno Supreme Court of California 1. Facts and procedure history Facts: • Escola (Plaintiff) was a waitress in the restaurant. • While she was moving the bottles of Coke from the cases which had been delivered to her restaurant at least 36 hours before to the refrigerator, one of them exploded in her hand, causing her to be severely injured. •The plaintiff alleged that the Coca Cola Company (Defendant) had been negligent in selling "bottles containing said beverage which on account of excessive pressure of gas or by reason of some defect in the bottle was dangerous ... and likely to explode." • Escola sued Coca Cola Bottling Co. to recover damages for personal injuries. • Judgment for plaintiff at trial • Defendant appealed 2. Issue: Is the manufacturer liable for the injuries under the inference of negligence? 3. Holding: Yes. Judgment for Plaintiff following the doctrine of res ipsa loquitor 4. Rule of law: Res ipsa loquitur does not apply unless (1) A defendant has had exclusive control of the thing causing the injury (2) The accident is of such a nature that it ordinarily would not occur in the absence of negligence by the defendant. 5. Reasoning: • It doesn't matter that we can't tell precisely whether the explosion was caused by an excessive charge or a defect in the glass. Coca-Cola vs. Pepsi Co

...Coca-Cola vs. Pepsi Co 2 1. Using the current ratio, discuss what conclusions you can make about each company’s ability to pay current liabilities (debt). The current ratio measures the company’s ability to pay its short term obligations with its short term assets. Between Coca Cola and PepsiCo, PepsiCo has a higher current ratio implying that is more capable of paying its obligations. The debt management policies of Coca-Cola in conjunction with share repurchase program and investment activity resulted in current liabilities exceeding current assets. From the ratio Pepsi Co suddenly had to pay all its short-term creditors, it would be able to do so and have a surplus of 44% of current assets. If Coca-Cola had to pay all its short-term obligations, it would have only 13% surplus of current assets after fully repaying all short term obligations. Therefore, it can be said that PepsiCo is more liquid than Coca Cola based on its current ratio. | Coca-Cola | Pepsi Co. | Current Ratio | 1.13 | 1.44 |   2. Using the profitability ratios, discuss what conclusions you can make about each company’s profits over the past three years. The return on assets ratio is an indicator of how profitable a company is relative to its total assets. Case Analysis: Coca-Cola Co

...1. Situation Analysis Case Background Created in 1886 by Dr. John Pemberton, Coca-Cola has gone through many changes, some good and some bad, but in the end has become the worldwide leader in its industry (Graham, 2011). The company boasts a lineup of approximately 500 different drinks, including soft drinks, teas, coffees, juices, and waters. Soft drinks are their “cash cow” with around two billion cans and bottles sold each day (Graham, 2011). The syrup originally was designed as a "cure-all tonic" and contained coca leaves (Davis, 2004). Two years after creating the mixture, and just before he died, Dr. Pemberton sold the rights to the beverage to Asa Candler. Due to increasing demand Joseph Biedenharn started bottling Coca-Cola and bottled distribution of the soda began; within five years large scale bottling operations became available. Throughout the company's history, and even today, it has faced and overcame many challenges. Coca-Cola was, until recently, the world’s most valuable brand (Elliott, 2013), but is still the worldwide leader in the beverage industry. Through all the successes, Coca-Cola has encountered some challenges along the way. Coca-Cola has been criticized for discrimination against minority employees, poor working conditions of migrant workers, and even assassinations of trade union leaders and union-affiliated workers that provoked protests (Raman, 2007). Another emerging issue the company is facing is criticism that their products are......
