Service: A Duty? A Benefit? Or Both, Or Perhaps Neither?

While the choice of service to your country, on a national, state or local government level, is an admirable and important endeavor, the choice should be driven by one's own conscience. To think globally, or for the good of the nation and even for the future - cannot be forced! It has to be a part of who you are, what you stand for and your ability to see beyond your own need. Compelling someone to serve, as in the military draft(conscription), is a non effective notion that will not guarantee the strength and quality of its military and further divides us, as a nation. There exists examples of what conscription can do to a nation from the Vietnam War/Conflict. People chose to leave their country, casting off all that they knew and loved instead of serving in the military. Anti Draft and Anti War demonstrations were everywhere, chaos. Citizens faced prison time and were ostracized because of their refusal to serve and their views against the draft and war. A matter of Patriotism can not be governed by politicians and gauged by others who have different views from yours – it should be left up to the individual. There is no evidence to prove that because of the draft, we were a fighting force to be reckoned with or we had the most proficient fighting Soldiers in history, or that the cost of the war was less expensive. There is, however, more evidence to prove the contrary. If someone wishes to serve their country, there have been various programs to do this in lieu of joining the military. Yet, these programs are underfunded and less advertised than service to the military. It seemingly forces an individual to choose service by joining a particular branch of the military or no service at all. Schnur’s argument is that once either party gets the vote of moderates and obtains power, the use of moderates is no longer needed. Schnur’s use of pathos in his article is much underlying. It isn’t until the end of his article we feel anything. He ends with, “That’s why Senator Arlen Spector is now a Democrat, why Senator Evan Bayh is not running for re-election, and why Bart Stupak is about to become a former member of Congress.” He provides us with the many examples of moderates who are either no longer needed, or have had to change their views completely. Each of these men stood firmly for causes, favored and rejected by both parties. Once either party gained control, they had no use for the moderates. The pressure from Congress and social groups cause these men to completely exit politics or change their stances and join the party in control. This example also gives us logos. Since moderates are either dropping out or changing their values, does this really mean control is the government’s main concern? The facts we are provided with suggest that this the ultimate goal. The use of moderates to maintain control of the government is what Schnur is suggesting. Miller* Fiduciary duties are critical to the integrity of a remarkable variety of relationships, including those between trustee and beneficiary, director and corporation, agent and principal, lawyer and client, doctor and patient, parent and child, and guardian and ward. Notwithstanding their variety, all fiduciary relationships are presumed to enjoy common characteristics and to attract a core set of demanding legal duties, most notably a duty of loyalty. Surprisingly, however, the justification for fiduciary duties is an enigma in private law theory. It is unclear what makes a relationship fiduciary and why fiduciary relationships attract fiduciary duties. This article takes up the enigma. It assesses leading reductivist and instrumentalist analyses of the justification for fiduciary duties. Finding them wanting, it offers an alternative account of the juridical justification for fiduciary duties. The author contends that the fiduciary relationship is a distinctive kind of legal relationship in which one person (the fiduciary) exercises power over practical interests of another (the beneficiary). Fiduciary power is a form of authority derived from the legal capacity of the beneficiary or a benefactor.
